Arkansas sues Kalshi over ‘mental health harms’
Arkansas’s attorney general says Kalshi’s prediction markets pose mental health risks.
The hit
Arkansas’s attorney general has sued Kalshi, alleging the prediction market platform runs an illegal gambling operation in the state. Tim Griffin said Kalshi’s contracts let users wager on ‘just about anything’, including sports outcomes & that the platform’s risks include ‘excessive wagering, financial losses, depression, and other mental health harms’, according to his statement.
Why it matters
Kalshi insists its event contracts are derivatives regulated by the CFTC, not state gambling products, & has made that case in other lawsuits. Arkansas joins a widening fight pitting states against the CFTC over who actually controls prediction markets.
The record
| Arkansas lawsuit filed | 4 November 2026 |
|---|---|
| Utah criminal charges | Filed last week against Kalshi, CEO Tarek Mansour & COO Luana Lopes Lara |
| Utah civil lawsuit | Filed before the criminal charges, also naming two Susquehanna trading firms |
| States sued by CFTC | At least 10 states |
What happens next
Kalshi had not commented at the time of The Block’s report. Watch for Kalshi’s court filings & whether more states follow Arkansas & Utah into direct legal action.
