Nine NY sportsbooks face AI ban on personalised promotions
Both proposals cleared the New York State Gaming Commission unanimously.
The hit
The New York State Gaming Commission has approved two proposals to limit sportsbook AI use & force operators to flag at-risk bettors, according to Sports Betting Dime. One rule would bar AI from crafting personalised promotions, odds or wager suggestions for the state’s nine licensed sportsbooks. The other sets betting thresholds to trigger responsible gaming check-ins.
Why it matters
If adopted, New York’s licensed sportsbooks would lose the AI tools used to tailor bonuses, odds & bet suggestions to individual customers. Operators would also have to check in with flagged bettors & assign a representative to explain responsible gaming tools once a customer crosses set thresholds. New York’s move follows Massachusetts, where regulators launched their own AI review after a New York Times report alleging DraftKings used AI to target likely losers.
The record
| AI rule | Would prohibit AI-crafted promotions, odds & wager suggestions for NY’s 9 licensed sportsbooks |
|---|---|
| Deposit threshold | Example trigger: deposits over $10,000 in 24 hours |
| Wagering threshold | Example trigger: betting over $1m in three months |
| Comment period | 60 days of public comment before a final commission vote |
| Massachusetts precedent | Massachusetts Gaming Commission announced its own AI review last month |
What happens next
Both rules enter a 60-day public comment period before returning to the commission for a final vote. Commission Chairman Brian O’Dwyer said operators “need to solve this problem” or the commission will impose its own solution.
